ORDER ACCEPTANCE & CANCELLATIONS
Emrald Labs reserves the right to accept, decline, cancel or modify any order prior to dispatch, even after an automated confirmation has been issued. Circumstances may include (without limitation):
If your order is cancelled prior to dispatch, we may issue a store credit or provide a like‑for‑like replacement at our discretion (or otherwise act in accordance with your statutory rights under applicable consumer laws).
ORDER MODIFICATIONS
Orders may be eligible for modification within 30 minutes of placement. For details on what can be changed and how, please refer to our FAQs or contact info@emraldlabs.com.
PROMOTIONS, DISCOUNTS & FREE GIFTS
Free gifts (e.g., with orders over a specified threshold) are while stocks last. For bundle promotions that include a free item (e.g., “buy a pre‑workout, get a free creatine”), the free item is limited to one per customer unless expressly stated. Purchasing multiple quantities of the main item does not entitle you to multiple free gifts unless specified.
Each promotion or special campaign may be subject to separate terms, eligibility requirements and expiry dates shown on the relevant pages.
INCORRECT SHIPPING INFORMATION
You are responsible for ensuring all contact and shipping details are accurate at the time of purchase. Emrald Labs is not liable for orders shipped to an incorrect address provided by the customer. If an order is returned due to incorrect or incomplete address details, you may be responsible for additional shipping fees to re‑send the order.
EASY PROTECTION (FREIGHT/SHIPPING PROTECTION)
We take care to pack and dispatch securely, but transit issues can occur. For peace of mind, we offer Easy Protection at checkout, an optional service that covers loss or damage in transit.
Eligibility: Easy Protection is non‑refundable once the order is dispatched and limited to one claim per customer or shipping address per year. Claims may be denied in cases of negligence, fraud, or where the item remains safe for use.
Outcome: If Easy Protection was purchased, we may, at our discretion, issue store credit or send a replacement. Refunds are not offered for transit‑related issues.
Timeframes: Claims must be submitted within 7 days of delivery (or expected delivery for lost shipments) and include clear photos and order details. Orders without Easy Protection are not eligible for Emrald Labs support on transit loss/damage and must be claimed directly with the courier.
Safe‑place authority: Once delivery is confirmed, responsibility shifts to the customer. If you authorise “leave in a safe place” and theft occurs post‑delivery, we are not liable. Consider secure options such as being home, a PO Box, or a parcel locker.
CONSUMER GUARANTEES (AUSTRALIAN CONSUMER LAW)
We guarantee our products are of acceptable quality and accurately described. Faulty goods generally include broken/missing seals, visible manufacturing defects, or goods that are expired at delivery (unless disclosed as short‑dated prior to purchase). Damage occurring during transit is not a product fault (this is addressed under Easy Protection or with the courier).
Your rights under the Australian Consumer Law (ACL) remain unaffected. Where goods are faulty, not as described, or incorrectly supplied, you may be entitled to a repair, replacement or other remedy in line with the ACL. Where the ACL requires a monetary remedy, we will comply with the law.
USER CONDUCT & CONTENT
Harassment in any manner or form on the site, including via email or chat, is strictly forbidden. Impersonation of others (including Emrald Labs staff or representatives) is prohibited. You may not upload, distribute, or publish through the site any content that is libellous, defamatory, obscene, threatening, invasive of privacy or publicity rights, abusive, illegal, or otherwise objectionable; that may constitute or encourage a criminal offense; that violates the rights of any party; or that otherwise gives rise to liability or violates any law. You may not upload commercial content or use the site to solicit others to join or become members of any other commercial online service or organisation.
We may, but have no obligation to, monitor, edit or remove content that we determine in our sole discretion to be unlawful, offensive, threatening, defamatory, pornographic, obscene or otherwise objectionable or violative of any party’s intellectual property or these Terms.
THIRD‑PARTY LINKS
We may link to third‑party websites. We do not control these sites and are not responsible for their content, privacy practices or services. Please review third‑party policies before engaging in any transaction.
LIMITATION OF LIABILITY
To the fullest extent permitted by law, Emrald Labs will not be liable for indirect, incidental, special or consequential damages arising from your use of our site or products. Nothing in these Terms excludes, restricts or modifies any consumer guarantees, rights or remedies under the ACL that cannot be excluded, restricted or modified by agreement.
GOVERNING LAW & DISPUTE RESOLUTION
These Terms are governed by the laws of Australia. You agree that jurisdiction over and venue in any legal proceeding directly or indirectly arising out of or relating to this site shall be in the courts of Australia.
TERM; TERMINATION
These Terms are applicable to you upon accessing the site and/or completing the registration or shopping process. We may terminate these Terms (or any part of them) at any time without notice, for any reason. Provisions relating to intellectual property, disclaimers, limitation of liability, indemnification, and miscellaneous terms survive any termination.
NOTICES
We may deliver notices to you by email, a general notice on the site, or by other reliable methods to the address you have provided.
MISCELLANEOUS
Any cause of action or claim you may have with respect to the site must be commenced within one (1) year after the claim or cause of action arises. Our failure to insist upon or enforce strict performance of any provision shall not be construed as a waiver. Neither the course of conduct between the parties nor trade practice shall modify these Terms. We may assign our rights and duties under this Agreement to any party at any time without notice to you.
